I move:

(1) That the following matter be referred to the Procedure Committee for inquiry and report by Wednesday, 4 February 2026:

Senate orders for the production of documents, with particular reference to:

(a) the growth in public interest immunity claims and other

non-compliance by the Government in response to orders for the production of documents;

(b) the legitimacy of public interest immunity claims raised by the Government;

(c) measures available to the Senate when the Government fails to comply with orders where public interest immunity claims have been rejected by the Senate; and

(d) any other related matters.

(2) That for the purposes of this inquiry only:

(a) participating members may be appointed to the committee on the nomination of the Leader of the Government in the Senate or Leader of the Opposition in the Senate, or any minority party or independent senator; and

(b) such participating members may participate in hearings of evidence and deliberations of the committee and have all the rights of members of the committee except that a participating member may not vote on any questions before the committee.

(3) That the committee have the power to consider and use the records of the Procedure Committee appointed in previous parliaments.
