The issue I have with the way it is drafted—and again this has been raised by way of feedback and certainly in submissions—is that it doesn't accord with the recommendations of professional bodies like the Law Council. What I put to you is that there is nothing in the drafting proposed by the government that requires a court to take into account the child's maturity, level of understanding or any other factors that it considers affect the weight the court should give to the child's views, is there?
