But can I just add that 137B(1)(e) requires Fair Work Australia to consider the consequences of not making the order for any employer, employees or organisation. It is reasonable to look at the consequences on an employer. Not all employees are members of a union. We look at the wishes of members and consequences to other employees and, of course, the employer.
