The question now is that the amendments circulated by the honourable member for Bradfield be agreed to.

Member for Bradfield's circulated amendments—

(1) Clause 27, page 43 (line 16), omit "the licence holder.", substitute "the licence holder; and".

(2) Clause 27, page 43 (after line 16), after paragraph (1)(b), insert:

(c) if a gas market code has prescribed circumstances for the purposes of paragraph 19(7)(a)—the licence holder is unable reasonably to bring it about that the licence holder is taken under paragraph 19(7)(a) to have made a DSO supply of natural gas in the market during the regulated period or extended period.

Note: For paragraph (c) of this subsection: paragraph 19(7)(a) allows a gas market code to prescribe circumstances in which a licence holder is taken to make a DSO supply of natural gas in a domestic gas market during a period. The circumstances must relate to supplying renewable gas in the market or reducing demand for natural gas in the market (see subsection 19(8)).

(3) Clause 27, page 43 (line 28), omit "natural gas.", substitute "natural gas; and".

(4) Clause 27, page 43 (after line 28), after paragraph (2)(b), insert:

(c) as mentioned in paragraph (1)(c)—take into account:

(i) if the gas market code has prescribed circumstances for the purposes of paragraph 19(7)(a) that relate to a matter mentioned in paragraph 19(8)(a)—the options available for supplying renewable gas in the market during the regulated period or extended period; and

(ii) if the gas market code has prescribed circumstances for the purposes of paragraph 19(7)(a) that relate to a matter mentioned in paragraph 19(8)(b) or (c)—the options available for reducing demand for natural gas in the market during the regulated period or extended period.

(5) Clause 27, page 44 (after line 13), after paragraph (4)(b), insert:

(ba) if a gas market code has prescribed circumstances for the purposes of paragraph 19(7)(a)—the Minister is satisfied that it would be uneconomic for the licence holder to bring it about that the licence holder is taken under paragraph 19(7)(a) to have made a DSO supply of natural gas in the market during the regulated period or extended period; and

Note: For paragraph (ba) of this subsection: paragraph 19(7)(a) allows a gas market code to prescribe circumstances in which a licence holder is taken to make a DSO supply of natural gas in a domestic gas market during a period. The circumstances must relate to supplying renewable gas in the market or reducing demand for natural gas in the market (see subsection 19(8)).

(6) Clause 27, page 44 (before line 18), before subclause (5), insert:

(4A) The Minister must, in considering whether the Minister is satisfied as mentioned in paragraph (4)(ba), take into account:

(a) if the gas market code has prescribed circumstances for the purposes of paragraph 19(7)(a) that relate to a matter mentioned in paragraph 19(8)(a)—the options available for supplying renewable gas in the market during the regulated period or extended period; and

(b) if the gas market code has prescribed circumstances for the purposes of paragraph 19(7)(a) that relate to a matter mentioned in paragraph 19(8)(b) or (c)—the options available for reducing demand for natural gas in the market during the regulated period or extended period.
