Questions without Notice

My question is again to the Special Minister of State. In the minister's statement earlier today, he claimed that he could have been answering a different part of the question when he answered, on 60 Minutes:

Yes, I did.

Given it is obvious from the tapes that there is only one question which was asked, hasn't the minister not only misled the parliament again but breached clause 5.1 of the Prime Minister's Statement of Ministerial Standards?
