to move:

That this House:

(1)
acknowledges the difficulties faced by Australian farmers in ensuring adequate warranty protection for farm equipment;
(2)
notes that:
(a)
recent evidence included in the December 2009 report of the Economic and Finance Committee of the South Australian House of Assembly indicated that much farm machinery and equipment is too expensive to be covered by implied warranty if explicit warranty fails; and
(b)
there appears to be little scope for redress where problems are protracted or where equipment failure leads to serious production losses; and
(3)
supports:
(a)
further investigation of any measures for improvements for farmers’ protection in this area, whether through dispute mediation provisions or extension of warranty protection; and
(b)
the establishment of a Code of Practice for farm machinery, establishing service standards and support for purchasers, dealers and manufacturers and articulating a requirement for all parties to act in good faith.
