I refer the minister to the following statements he made today: ‘I am not going to start speculating on the details of the fairness test.’ ‘It’ll all become very clear when the legislation is presented to the House.’ ‘We’re certainly working through with the draughtsmen. It is obviously a process, but we’re working through it.’ Minister, doesn’t this mean that, since 12.01 am on Monday, your government has been forcing employers to comply with a test that has not even been drafted yet?
