No, this is not xenophobic. This is the first time this issue has arisen. What happens in that instance? Are we going to put restrictions in place for the use of ISDS by state owned enterprises? That is what I would like to know. Are we going to put those restrictions in place? It adds a huge layer of complexity to Foreign Investment Review Board approval processes and what is and is not in our natural interest. That is all I asked Senator Brandis: why hasn't that issue been sorted out? It certainly has not even been raised—let alone all the bloated, overinflated estimates of what this is going to deliver to the economy, with no details of the downsides or the risk to Australian industries.
