I move:

That the Senate—

(a) notes that:

(i) order for the production of documents no. 253 relating to the National Disability Insurance Scheme Financial Sustainability Framework, made on 19 June 2023, has not been complied with, and

(ii) the Treasurer, in his response to the order, made a claim of public interest immunity on the basis that it would be detrimental to relations between the Commonwealth and the states and territories;

(b) rejects the public interest immunity claim made by the Treasurer, noting that the public interest in disclosing the document outweighs any potential prejudice to relations between the Commonwealth and the states and territories; and

(c) requires the Minister representing the Treasurer to comply with the order by no later than 4.30 pm on 22 June 2023.

The government does not support this motion. The government has complied with the Senate order. The public interest immunity claim made in respect of the materials sought was made in accordance with longstanding and accepted Senate practice.

The question is that the motion moved by Senator Steele-John be agreed to.
