1. The committee met in private session on Wednesday, 23 June 2021 at 7.14 pm.

2. The committee recommends that—

(a) the Coronavirus Economic Response Package Amendment (Ending Jobkeeper Profiteering) Bill 2021 be referred immediately to the Economics Legislation Committee for inquiry and report by 20 August 2021 (see appendix 1 for a statement of reasons for referral);

(b) the Courts and Tribunals Legislation Amendment (2021 Measures No. 1) Bill 2021 be referred immediately to the Legal and Constitutional Affairs Legislation Committee for inquiry and report by 13 August 2021 (see appendix 2 for a statement of reasons for referral);

(c) contingent upon introduction in the House of Representatives, the provisions of the Financial Sector Reform (Hayne Royal Commission Response—Better Advice) Bill 2021 be referred immediately to the Economics Legislation Committee for inquiry and report by 28 July 2021 (see appendix 3 for a statement of reasons for referral);

(d) the provisions of the Mitochondrial Donation Law Reform (Maeve's Law) Bill 2021 be referred immediately to the Community Affairs Legislation Committee for inquiry and report by 18 August 2021 (see appendix 4 for a statement of reasons for referral); and

(e) contingent upon introduction in the House of Representatives, the provisions of the Social Services Legislation Amendment (Consistent Waiting Periods for New Migrants) Bill 2021 be referred immediately to the Community Affairs Legislation Committee for inquiry and report by 14 September 2021 (see appendix 5 for a statement of reasons for referral).

(f) contingent upon introduction in the Senate, the Sex Discrimination and Fair Work (Respect at Work) Amendment Bill 2021 be referred for inquiry and report by 6 August 2021 but was unable to reach agreement on a committee (see appendix 6 for a statement of reasons for referral).

3.   The committee recommends that the following bills not be referred to committees:

              Tertiary Education Quality and Standards Agency Amendment (Cost Recovery) Bill 2021

                4. The committee deferred consideration of the following bills to its next meeting:

                      Customs Tariff Amendment (2022 Harmonized System Changes) Bill 2021

                                                                      Mitochondrial Donation Law Reform (Maeve's Law) Bill 2021

                                                                      Reasons for referral/principal issues for consideration:

                                                                      Mitochondrial donation is a complex medical and ethical issue with strong personal views held by the community and parliamentarians. In order to inform parliamentarians of the complex issues involved, a Senate inquiry is considered to be helpful.

                                                                                        An inquiry will allow the Ctee to consider the extent to which the amendment reflect the recommendations of the Respect @Work Report, and commitments made by the government to implementation of those recommendations.

                                                                                                    I move an amendment to the motion:

                                                                                                    At the end of the motion, add:

                                                                                                    "and, in respect of the Sex Discrimination and Fair Work (Respect at Work) Amendment Bill 2021, contingent upon introduction in the Senate, the bill be referred immediately to the Education and Employment Legislation Committee for inquiry and report by 6 August 2021."

                                                                                                    The amendment is very straightforward. It has been circulated in the chamber. It is to refer the Sex Discrimination and Fair Work (Respect at Work) Amendment Bill 2021 to the Education and Employment Legislation Committee, rather than the Legal and Constitutional Affairs Legislation Committee, for inquiry and report. We think it fits more appropriately there, because the Fair Work legislation normally goes to that committee.
