I have  some further information to add in response to Senator Xenophon’s question. I indicated that there was an application for special leave to appeal to the High Court. I can also advise that it has been publicly reported that that application has been withdrawn. In relation to the issue of a pardon, I indicated that it would not be appropriate to speculate on whether a pardon would be granted in any particular case but I am also advised that the option of applying for a pardon remains open to Mr Kessing. I am advised that he has not as yet availed himself of this course of action.
